民主行动党支持安华就华小高职风波公开认错,反观马华“恶人先告状”一味将所有责任推往安华身上,而不愿正视巫统打压华教的本质

2007年4月26日(星期四)在八打灵再也发表的声明:

民主行动党对人民公正党顾问安华依布拉欣就本身担任教育部长期间,委派不谙华文者到华小担任高职所引发的“华小高职风波”公开认错而深感欣慰。

安华敢于在20年的今天针对此事公开认错,其确实比身在国阵内部却不敢要巫统就此事道歉的马华领袖,显得更加有勇气担当及负责任。

对于安华愿意正视、反省及检讨自己过去所犯的错误,民主行动党除了深表欣慰之外,并没有忽略华小高职风波的根源,就在于巫统一直要打压华教的本质使然。

即使安华不情愿这样做,但仍要被巫统偏颇的制度框架,以及巫统所主导的种族偏极教育政策所局限。

民主行动党当年与马华及华团同仇敌忾,大力谴责安华当时的领导作风。即使事到如今,我们从没有姑息安华所犯下的过失,而且一直要他针对这件事情公开认错。

但是,我们绝不能一味将所有责任推往安华身上,反而忽略了巫统一直竭尽所能要打压华教的本质。

真正的根源其实不在安华身上,而是巫统领袖的极端性格使然。他们在建国50年来一直对华教采取不公平的待遇,而1987年华小高职风波只属冰山之一角。

如果马华只针对华小高职风波跟华社站在一起,却针对英文数教理、新经济政策死灰复燃、华小获不公平对待等课题背弃华社的共同意愿和利益,这又有何用呢?

随着安华针对华小高职风波认错后,民主行动党反过来挑战马华总会长黄家定公开要求首相兼巫统主席阿都拉巴达威,代表政府及巫统针对这起事件向全民认错!

否则,马华根本没有资格大言不惭地向华社承诺:要与华社与华教共进退!

廖中莱是否乐见古健杰与陈文宏组合为国阵助选,而输给去年一直面对冠军荒的李万华与钟腾福组合?

2007年4月19日(星期四)在八打灵再也发表的声明:

马青总团长兼青年及体育部副部长廖中莱不敢面对古健杰与陈文宏组合,被逼到马接选区为国阵助选而失意亚洲羽球锦标赛的事实,反而通过马青中委邓海强指责我利用羽球赛果来抨击政敌,乃侵犯本地体坛的不良先例。

我当然乐于看到李万华与钟腾福的球技突飞猛进,甚至足以打败最近勇夺阔别25年全英赛双打冠军与瑞士公开赛冠军的古、陈师弟组合;但是,看到古、陈这对“钻石组合”球艺在过去一个月来严重退步,我其实比廖中莱更心痛不已。

当古、陈于4月7日出席在马接举办的一场“热爱羽球运动推介礼”时,李万华与钟腾福当时也有在场。但是,廖中莱怎么可以倒果为因,来合理化古、陈被迫为马华助选的不合理事实呢?

根据报道,古、陈对成名后频频受邀出席各类活动大感吃不消。陈文宏甚至说,这使到两人的练习时间减少。古健杰更是对活动行程频密感到无奈。陈文宏接受电视新闻节目访问时,更爆出他们无意到马接进行表演,但在国阵安排下却不得缺席。

古、陈的教练烈西还警告两人停止一切庆祝及签名活动,以便专心备战。毕竟,两人自3月初出征全英赛以来,有长达3周没有正统训练。他们迟至3月27日才投入正常训练,以便备战4月10日至15日在新山举行亚洲羽球锦标赛。

即使李万华与钟腾福在4月7日当天到马接为国阵助选,但两人在过去一年来的长期正规训练并没有间断,以致他们还可以维持一定的表现水平。即使他们的球技没有表现得最好,但还不致于严重退步吧!

反观古、陈组合在3月杪投入正常训练后,在还未恢复原有的表现水平之前,又要在4月7日硬着头皮到马接为国阵助选,必然会影响到他们的训练进度。结果,人算不如天算,古、陈组合竟然败给赛前不受看好的李、钟组合。

唯一可让廖中莱欣慰的是,古、陈组合只是败给自家人,还不致于让我国白白丢失奖牌。否则,廖中莱不只是要对两人的败绩负起全部责任,甚至还要对此引咎辞职呢!

我希望马青领袖认清楚到底是谁将国家羽球队政治化、藉推广羽球运动假公济私地干预体育界发展,以遂马华狭隘的政治利益来扼杀杰出双打球员,进而创下侵犯国内体坛的不良先例,而不是一味将矛头指向民主行动党的领袖。

Surat Aduan Kepada SPR terhadap Salahlaku BN Semasa Pilihan Raya Kecil Machap

Yang Berbahagia Tan Sri,

Aduan terhadap Salahlaku Calon dan Petugas-petugas Barisan Nasional (BN) Semasa Pilihan Raya Kecil Machap

Saya ingin menarik perhatian pihak tuan terhadap salahlaku-salahlaku calon dan petugas-petugas Barisan Nasional (BN) semasa berlangsungnya pilihan raya kecil Machap dari 3hb sehingga 12hb April 2007.

2. Salahlaku-salahlaku tersebut adalah serius dan menyalahi undang-undang serta perlu diambil tindakan tegas baik oleh pihak polis mahupun pihak tuan demi kelicinan, keadilan dan kebersihan proses pilihan raya yang demokratik, seperti:

(1) Penyogokan melalui cara pembelian wang kepada pengundi-pengundi selepas membuang undi

Pada 12 April 2007 iaitu hari pengundian kira-kira jam 12.30 tengahari, saya menerima laporan bahawa banyak pengundi-pengundi yang telah membuang undi berkumpul di luar sebuah rumah kosong berhadapan dengan SJK (C) Khiak Yew, Tebong. Disyaki bahawa pengundi-pengundi tersebut telah diberikan sejumlah wang sogokan oleh orang yang berada dalam rumah itu, iaitu di antara RM50 hingga RM200 kepada setiap pengundi mengikut jarak rumah mereka ke tempat mengundi.

Repot polis 000115/07 telah dibuat di Balai Polis Tebong pada jam 1.00 petang. Foto-foto dan video yang kita ambil telah diserahkan ke IPK Melaka pada 13 April 2007 dan disertakan untuk tindakan pihak tuan yang selanjutnya. Kesalahan tersebut merupakan kesalahan jenayah serius yang menyalahi Seksyen 10 Akta Kesalahan Pilihan Raya 1954 dan boleh dihadapkan ke mahkamah serta dijatuhkan hukuman penjara tidak lebih dua tahun dan denda tidak kurang RM1,000 dan tidak lebih daripada RM5,000.

(2) Penyogokan melalui cara pembelian wang RM20 kepada setiap peserta sesi karaoke anjuran MCA

Mengikut laporan yang disiarkan dalam akhbar The Sun pada 11 April 2007, didapati setiap penduduk yang menyertai sesi karaoke anjuran MCA di kawasan rumah pangsa Machap Baru telah diberikan wang sebanyak RM20. Lebih kurang 40 penduduk di sekitarnya telah menyertai aktiviti tersebut. Keadaan ini juga berunsurkan penyogokan dan bertujuan untuk mempengaruhi pilihan mereka pada hari mengundi kelak.

(3) Merayu atau memujuk pengundi-pengundi supaya mengundi atau mengundi mana-mana calon pilihan raya dalam jarak 50 meter dari sempadan tempat mengundi

Mengikut Seksyen 26(1) Akta Kesalahan Pilihan Raya 1954, tiada seorang pun pada hari mengundi boleh merayu-rayu atau memujuk atau cuba memujuk mana-mana orang supaya mengundi atau tidak mengundi mana-mana calon dalam pilihan raya tersebut, dan juga dilarang berbuat demikian dalam jarak 50 meter dari sempadan mana-mana tempat mengundi.

Didapati pemimpin-pemimpin BN/MCA yang berpangkat Menteri juga terlibat dalam aktiviti-aktiviti tersebut. Foto-foto tersebut disertakan untuk membantu tindakan yang diambil oleh pihak tuan kelak. Mana-mana orang yang didapati bersalah boleh dipenjarakan tidak melebihi satu tahun atau didenda lebih RM1,000 dan tidak melebihi RM5,000 atau kedua-duanya sekali.

(4) Perbelanjaan pihak BN bagi pilihan raya kecil kali ini secara jelas telah melebihi RM100,000.

Jelasnya, perbelanjaan pihak BN bagi pilihan raya kecil kali ini telah melebihi RM100,000 jika hanya dihitung poster, banner dan bunting yang digantung, risalah dan CD yang diagihkan, serta makanan dan minuman yang telah dibelanjakan dalam tempoh pilihan raya tersebut.

Mengikut Seksyen 19(1) Akta Kesalahan Pilihan Raya 1954, tiada wang yang boleh dibayar dan tiada belanja boleh dilakukan oleh seseorang calon atau oleh ejennya semasa atau selepas sesuatu pilihan raya melebihi RM100,000 dalam hal sesuatu pilihan raya bagi kerusi Dewan Undangan Negeri dan adalah bersalah atas sesuatu perbuatan yang menyalahi undang-undang.

(5) Kes pergaduhan berdarah yang berlaku pada hari penamaan calon yang mencederakan dua orang ahli DAP dan layanan kasar serta ugutan terhadap wartawan-wartawan yang sedang bertugas

Insiden berunsur keganasan yang berlaku pada hari penamaan tersebut merupakan taktik kotor pihak BN untuk menakutkan para pengundi serta mendisplinkan para wartawan yang bertugas dalam pilihan raya kecil kali ini. Dalam kejadian tersebut, dua orang ahli DAP iaitu K. Kannis A/L Kanniah dan Vijayan A/L Arumugam telah dicederakan, seorang jurukamera bagi Harian Makkal Osai iaitu Malayandi A/L Pidaran dan seorang wartawan wanita bagi Harian Malaysian Nanban iaitu Malini A/P Rangasamy telah diugut.

Bendera parti MIC dan batu-bata telah digunakan sebagai senjata dalam kejadian tersebut. Mereka yang dipercayai merancang serta terlibat dalam insiden kali ini termasuklah Setiausaha Parlimen bagi Kementerian Belia dan Sukan Datuk S.A. Vigneswaran serta ahli-ahli Briged Pemuda MIC. Kelakuan tersebut adalah menyalahi Seksyen 4A Akta Kesalahan Pilihan Raya 1954 dan boleh dijatuhkan penjara tidak melebihi 5 tahun dan denda tidak melebihi RM10,000 atau kedua-duanya sekali. Repot-repot polis telah dibuat di Pondok Polis Machap Umboo pada 3 April 2007. Sehingga hari ini, tiada mana-mana orang dihadapkan ke mahkamah untuk diadili.

(6) Peruntukan kewangan yang diumumkan oleh calon BN secara tidak langsung boleh disifatkan sebagai bersalah atas kesalahan menyogok

Lawatan turun padang calon BN iaitu Lai Meng Chong ke Machap Baru pada 4 April 2007 dan menjanjikan peruntukan kewangan kerajaan negeri Melaka di antara RM6,000 sehingga RM13,000 bagi 5 unit rumah kediaman yang terlibat telah menyalahi Seksyen 10 Akta Kesalahan Pilihan Raya 1954 dan boleh dijatuhkan hukuman penjara tidak lebih dua tahun dan denda tidak kurang RM1,000 dan tidak lebih daripada RM5,000. Sebagai seorang calon, beliau memang tidak berkuasa untuk menjanjikan peruntukan kewangan kerajaan persekutuan atau negeri secara langsung atau tidak langsung.

Walaupun beliau menafi dirinya telah menjanjikan peruntukan kewangan tersebut dan hanya setakat membantu tuan-tuan rumah yang terlibat untuk mengemukakan borang permohonan mereka, namun ini bertentangan dengan apa yang telah dilaporkan dalam akhbar Sin Chew Daily pada 5 April 2007, dan menunjukkan bahawa peruntukan kewangan berjumlah lebih kurang RM50,000 telah diluluskan untuk tujuan pembinaan rumah atau memperbaiki bahagian-bahagian rumah yang telah rosak.

3. Walaupun perkara-perkara tersebut hanyalah merupakan sebahagian kecil perbuatan rasuah atau yang menyalahi undang-undang telah dilakukan oleh calon atau petugas-petugas, namun DAP mendesak pihak tuan supaya mengambil tindakan tegas dengan serta-merta untuk menyiasat serta menghadapkan mereka yang terlibat ke mahkamah.

4. Pihak tuan perlulah bertindak adil dalam membanteras segala perbuatan rasuah demi menegakkan keadilan serta menjamin keadilan, kebersihan dan kesaksamaan proses pilihan raya dalam negara kita. Segala tindakan tegas pihak tuan adalah dihargai.

Some voters were bribed, says DAP

PUTRAJAYA (April 17, 2007): The DAP today lodged a complaint with the Election Commission, alleging that some voters in the recent Machap by-election were bribed.

Ng Wei Aik, political secretary to DAP secretary-general Lim Guan Eng, handed over the complaint report to EC chairman Tan Sri Abdul Rashid Abdul Rahman, substantiating it with photographs and a video-recording.

The party will also lodge a report with the Anti-Corruption Agency this week.

In a six-point statement, DAP alleged the Barisan Nasional candidate for Machap, Lai Meng Chong, and election workers had breached election laws during the campaign and polling on April 12.

The specific complaints are:

- On April 12 at 12.30am, voters had gathered at an vacant house near SJK (C) Khaik Yew, Tebong, and were given between RM50 and RM200 each. A police report was lodged the next day.

- Those who attended a karaoke session organised by the MCA were given RM20 each.

- Lobbying for votes less than 50m from the polling area. Section 26 (1) of the Election Offences Act 1954 says those wanting to lobby for votes should be 50m or more from the polling station.

Photos of BN and MCA leaders, including ministers, involved in the lobbying were handed over to EC to substantiate this complaint.

- BN allegedly spent more than RM100,000 on the by-election. Section 19 (1) of the Election Offences Act 1954 states that a candidate or his agent cannot spend more than RM100,000 for a state assembly seat.

- The fight during nomination day between a BN component party and DAP members and threats made against reporters who were on duty,

- BN candidate Lai had gone to Machap Baru on April 4 and promised a Malacca government allocation of RM6,000 to RM13,000 for five units of houses.

Abdul Rashid was not available for comments.

However, he had earlier reportedly said development promises by ministers to voters during an election could not be construed as vote-buying.

He had also said vote-buying was not the EC's problem, and that it was for the ACA to investigate.

In the Machap by-election, BN's Lai beat DAP's Liou Chen Kuang by a majority of 4,081 votes.

The Coalition for Clean and Fair Election (Bersih) today told a press conference they opposed Abdul Rashid's statement that pledges do not tantamount to vote-buying.

Its representatives, PAS Central Committee member Dr Syed Azman Syed Ahmad and Parti Keadilan Rakyat vice-president R. Sivarasa and DAP stalwarts Teresa Kok and Liew Chin Tong, described Abdul Rashid's statement as irresponsible.

"The chairman should re-examine his position as this shows that the EC is not transparent, and it makes fools of the people instead of fulfilling the public's demand for fair and clean elections," said Syed Azman.

列举国阵在马接补选违法行举 行动党向选委会投诉选举舞弊

【本刊记者撰述】民主行动党今早前往布城马来西亚选举委员会(Suruhanjaya Pilihan Raya,简称SPR)办事处投诉,指国阵在为期九天的马六甲马接区(Machap)州议席补选的竞选期间,涉及贿票、暴力、滥权等问题。

他们举列的六项违法行为,包括投票日以金钱贿选、马华公会举办卡拉OK,给参加者各马币20元贿选、投票日当天在距离投票中心不到50公尺处拉票、国阵选举总开销超过马币10万元、殴斗事件以及国阵候选人在竞选期间拨款。

出席会见选委会的代表包括民主行动党秘书长政治秘书黄伟益、马接区州议席补选候选人廖政光、民主行动党秘书长经济顾问潘俭伟、联邦直辖区州委员会副主席陈倡翰、胡佑强、林瑞光与邓晓璇;而负责接领的选委会代表是沙布里沙益。

他们在致给选委会主席阿都拉昔(Ab Rashid bin Ab Rahman)的投诉信函中,强调他们列举的例子只是冰山一角,并希望选委会能够正视此事件,调查有关指责。

他们列举的六项违法行举包括:

此举触犯《1954年选举罪行法令》第10条文,罪名成立可判监禁不超过两年,罚款不少于马币1000元,惟不超过马币5000元。

二、根据《太阳报》(The Sun)报道,马华公会在马接巴鲁(Machap Baru)组屋举办卡拉OK演唱会,每名参赛者获马币20元,约有40人参赛。

三、在距离投票站少于50公尺处拉票,其中包括马华公会籍部长。此举触犯《1954年选举罪行》第26(1)条文,罪名成立可判监禁不超过两年,罚款不少于马币1000元,不超过马币5000元,或两者兼施。

四、马华公会竞选开销明显超过法定的马币10万元,触犯《1954年选举罪行法令》第19(1)条文。

五、欧斗事件,国大党党员在提名日(4月3日)殴打民主行动党党员,并粗暴对待在场执行任务的新闻从业员。此举触犯《1954年选举罪行法令》第4A条文,罪名成立可判监禁不超过五年,以及罚款不超过马币1万元,或两者兼施。

六、宣布拨款。马华公会候选人赖明忠于4月4日,在马接巴鲁承诺拨款给五户人家,数目各从马币6000元至1万3000元不等。此举触犯《1954年选举罪行法令》第10条文,若罪名成立可判监禁不超过两年,罚款不少于马币1000元,惟不超过马币5000元。

投诉信函说,虽然赖明忠后来否认,并澄清只是协助有关家户提出申请,但是根据4月5日的《星洲日报》报道,约马币5万元的拨款已经被批准,作为建筑与装修屋子的开销。

Drag poll wrongdoers to court, EC told

DAP has urged the Election Commission (EC) to identify and prosecute those who flouted the law to secure a ‘dishonourable’ victory for Barisan Nasional (BN) in the Machap by-election.

In a memorandum to EC today, the opposition party called on the commission to identify those guilty of bribery and intimidation in the run-up to the contest for the Malacca state seat.

The memorandum was submitted by Ng Wei Aik (photo, middle), the political secretary to DAP secretary-general Lim Guan Eng, to EC public relations officer Sabri Said (photo, right) at the commission’s headquarters in Putrajaya.

Also present was DAP candidate for Machap, Liou Chen Kuang (photo, left).

Contacted later, Ng said those guilty must be prosecuted under the Election Offences Act 1954.

“We want EC to investigate the incidents we have highlighted in our memorandum and drag those involved to court,” he added.

In the April 12 by-election, BN candidate Lai Meng Chong swept to victory over Liou with a 4,081 vote majority.

Attached to the four-page memorandum were photographs allegedly depicting voters receiving money from a BN operations room on polling day.

The memorandum also referred to the newly-paved roads, hundreds of new street lamps, a RM1.2 million recreational area near the Durian Tunggal Dam as well as the announcement to Machap voters of a host of other development projects.

“This is a clear breach of election regulations, which limit campaigning expenditures for a state seat to RM100,000,” said Ng.

Karaoke session

Yesterday, EC chairperson Abdul Rashid Abdul Rahman said allocations, given out or promised in kind by ministers and government officials during elections, cannot be deemed as bribery.

However, he also stated that election candidates and political parties cannot make promises to voters during an election.

On this point, Ng said DAP had noted in its memorandum that Lai had on April 4 allegedly promised an allocation of RM6,000 to RM13,000 for the construction of five houses in Machap Baru.

Another example of ‘bribery’ highlighted was the RM20 paid to Machap Baru apartment residents who participated in an MCA-organised karaoke session on April 11.

Ng said the memorandum also touched on the fracas that took place on nomination day ( April 3) which saw two DAP members hurt.

Apart from these, he said BN-MCA ministers had also breached elections regulations when they urged voters to choose the ruling coalition on polling day itself.

He said photographic evidence were also furnished to EC on BN leaders allegedly campaigning within 50 meters of polling stations which is prohibited under the Election Offences Act.

廖中莱必须对古健杰与陈文宏被迫协助国阵到马接助选,而失意亚洲羽球锦标赛负起全部责任!

2007年4月16日(星期一)在八打灵再也发表的声明:

本月15日在柔佛州新山举行的亚洲羽球锦标赛男双决赛,最近摘下全英赛冠军与瑞士公开赛冠军的“钻石组合”古健杰与陈文宏,竟然不敌过去一年面对冠军荒的李万华与钟腾福,而以14比21、21比11、12比21败下阵来。

古健杰在赛后自我检讨说:“自从夺得全英与瑞士公开赛冠军后,我们就缺少系统性的训练,我发现自己的双脚没有力。现在我很想立刻重回训练场上,以逐步完善自己不足的地方。”

这足以反映古健杰与陈文宏对最近要出席一系列宣传与造势活动,尤其被逼到马六甲马接选区为国阵助选有所怨言,更怀疑这些活动直接或间接导致他们缺少系统性的训练,无法拿下两人合作半年以来的第5座冠军。

对于这点,民主行动党要青年及体育部副部长拿督廖中莱将国家羽球队政治化,藉邀请古健杰与陈文宏为马接区州议席补选造势,以满足马华狭义的政治利益负起全部责任。

廖中莱在补选期间滥用其副部长权位,安排两人到马接出席所谓的“热爱羽球运动推展礼”,证明马华企图借用两人的知名度,来吸引更多村民到来捧场。然而,这项活动实质上更像是一场球迷签名会,对推广羽球运动似乎没有实质助益。

古健杰与陈文宏的教练雷西曾经警告他们,若分散两人对练习活动的注意力,将会影响他们发挥更好的体育潜能。尽管如此,廖中莱把雷西的警告当作耳边风,终使两人与亚洲羽球锦标赛冠军擦身而过,廖中莱必然要负起全部的责任。

民主行动党希望马来西亚羽球总会严正看待这个问题,并阻止廖中莱或青年体育部长阿莎丽娜、政务次长威尼斯瓦兰等人有机会滥用国家羽球队成员,出席各种不必要的宣传活动以遂个人政治利益,进而影响我国羽球国手在国际赛会的临场表现。

我更希望看到政治回归政治,羽球回归羽球,并让古健杰与陈文宏能够享有不受干扰的训练机会与空间,以成就我国要赢得第一面奥林匹克金牌的梦想。

No surprise

MACHAP (April 12, 2007): There was a no surprise result. There was no mood swing among the rural electorates. As expected, Barisan Nasional (BN)'s superior machinery streamrolled for an overwhelmingly win in the by-election, as it did in the 2004 general election.

But, the 481 decrease in the winning margin announced tonight did spoil the party for the BN which had clearly worked their hearts out to try and secure an even wider mandate.

Machap is also the first Chinese-majority constituency to see a by-election since the 11th General Election.

Machap is made up of 45% Chinese and the by-election was caused by the death of Malacca MCA chief Datuk Poh Ah Tiam on March 15.

The by-election is also seen by many political observers as a barometer to gauge the mood of the voters, especially the Chinese before the next general election. But this is an exceptionally rural electorate.

The increased in votes for DAP in the Chinese-majority area of Machap Baru, though insignificant, is still a wake-up call for the MCA. More so, Machap Baru is Poh's kampung.

In their respective post-mortems, the MCA will do well to determine the grouses of the Machap Baru Chinese while the DAP must surely find a way to win the hearts of the Malays and Indians for any real possibility to unseat the BN in the next general election.

This time around, DAP secured 527 votes while MCA garnered 914 votes in Machap Baru. In 2004, MCA garnered 1,270 votes while DAP got only 356 ballots.

The BN was confident of a bigger majority by fielding "local boy" Lai Meng Chong. The DAP's Liou Chen Kuang is from Malacca town.

"The residents here voted for BN in last general election because of Datuk Poh Ah Tiam. He had done a lot for the villagers. But what has Lai done for us? We know him too well (to know his weaknesses)," said a young voter when met in Machap Baru on Wednesday night.

For the BN and Umno, they can take heart that, depsite the thousands that turned up at former Deputy Prime Minister Datuk Seri Anwar Ibrahim's ceramah on Wednesday night, the crowd did not translate into votes.

Anwar had also made his rounds in Malay villages that saw him locked in warm shakes which did not really mean electoral support.

The BN was also able to retain the support of the Indian community. Machap is one of the few constituencies that feature a high percentage of Indian voters - at 15%.

DAP secretary-general Lim Guan Eng's political secretary Ng Wei Aik said: "We had no chance to even talk to the voters in the Malay and Indian villagers who were either satisfied with the BN or had been intimidated not to see us."

The Opposition had raised many national issues, alleged scandals and corruption but clearly these did not impact the rural folk.

Although the BN had won the by-election with its "development" trademark, unfortunately it had been marred by allegations of vote-buying and abuse of government machinery.
